Terms of Use

These terms govern your use of this website and, once released, the Kimro application for iPhone. Both are operated by SyncAgency LLC, a limited liability company registered in the State of New Mexico, United States (Business ID 0008090888).

Kimro is not yet available. The sections below that describe the application will apply from the day it is published on the App Store.

1. Accepting these terms

By using this site or the app you accept these terms. If you do not accept them, do not use them. You must be at least 13 years old, or 16 in the European Economic Area unless local law sets a lower age.

2. What Kimro does

Kimro is a screen time application. The applications you choose are restricted through Apple’s Screen Time frameworks and stay restricted by default. Completing a timed focus session earns credits, and credits open a temporary unlock window. When the window expires, the restrictions are re-applied.

3. Credits

• Credits are an internal accounting unit. They have no monetary value.
• Credits cannot be purchased. There is no in-app purchase that adds credits to a balance. They are earned by completing focus sessions.
• Credits cannot be exchanged, transferred between accounts, sold, or redeemed for money, goods or services of any kind.
• Credits accrued during a session are added to your balance only when that session completes. If a session is abandoned or forfeited under the rules you selected, those credits are lost. The app states this before a session starts.
• We may change how credits are earned, spent or capped. Where a change reduces the value of an existing balance we will give notice in the app beforehand.

4. Subscriptions

Kimro will be free to download. Some features may require an auto-renewable subscription. The ability to restrict applications and to earn unlock time is available without payment.

Subscriptions are sold and billed by Apple through your Apple Account, under Apple’s terms. Price, currency, any free trial and the first billing date are shown before you confirm. Subscriptions renew automatically until cancelled; you can cancel at any time in your Apple Account settings, and cancelling takes effect at the end of the current period. Refunds are handled by Apple, not by us.

5. Acceptable use

You agree not to:

• circumvent, tamper with or automate the session, motion-detection or credit mechanics;
• use another person’s account, or share credentials with the intention of inflating a balance or a ranking;
• reverse engineer, decompile or attempt to extract the source of the application, except to the extent that applicable law expressly permits it;
• interfere with our infrastructure, or attempt to access accounts or data that are not yours.

We may suspend or close an account that breaches these rules. Where we do, we will say why.

6. What we do not promise

Kimro depends on Apple’s system frameworks and on the behaviour of your device. Restrictions can be affected by operating system updates, device settings, low-power states, or by you revoking the Screen Time permission. We do not warrant that Kimro will prevent all access to a restricted application at all times.

Motion detection and the AR lock box are approximations of physical presence and can produce false positives or false negatives. The AR mode is marked experimental inside the app for that reason.

Kimro is not a medical device and is not treatment for any condition, including attention disorders or behavioural addiction. It is not a substitute for professional advice.

Except where the law does not allow it to be excluded, the service is provided “as is”, without warranties of any kind.

7. Limitation of liability

To the fullest extent permitted by law, SyncAgency LLC is not liable for indirect, incidental, special or consequential damages, or for loss of data, revenue or opportunity, arising from your use of the site or the app. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Nothing here limits liability that cannot lawfully be limited, including for death, personal injury or fraud.

8. Intellectual property

The Kimro name, the application, this site, and their design, code and content belong to SyncAgency LLC. Using the service does not transfer any of those rights to you.

9. Changes and termination

We may update these terms. The date at the top of this page always shows the current version, and material changes will be announced in the app before they take effect. You can stop using the service at any time and delete your account from within the app.

10. Governing law

These terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law rules. Where you are a consumer resident in the European Economic Area or the United Kingdom, this does not deprive you of the protection of the mandatory rules of your country of residence.
